1. Nature of Services & Regulatory Limitations

MP Housing Solutions & ALE ("Company," "we," "us," or "our") operates as an independent corporate lodging, relocation, and temporary housing provider. We are not an insurance company, insurance underwriting agency, claims adjusting firm, or public adjuster.

We do not evaluate structural property damages, settle claims, provide legal claim representation, or issue insurance claim benefit disbursements. Our services are strictly confined to sourcing furnished temporary residential properties, executing corporate occupancy agreements, and coordinating direct vendor billing under the policyholder's Coverage D (Additional Living Expense / Loss of Use) insurance benefits.

2. Acceptance of Terms & Eligibility

By accessing our website, submitting an intake or referral form, creating an account on our GoHighLevel Client Portal, or occupying a property coordinated by us, you ("User," "Client," or "Policyholder") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services or portal. Users must be at least 18 years of age and legally competent to enter into binding agreements.

3. Direct Pay Authorization & Insurance Billing

  • Direct Billing Arrangement: Clients utilizing our services for insurance-covered temporary displacement must execute a standard Direction to Pay / Direct Pay Authorization (DPA). This authorization instructs your insurance carrier to remit corporate lodging, utility, and related occupancy fees directly to MP Housing Solutions & ALE.
  • Policyholder Primary Obligation: While we bill your insurance company directly as an approved housing vendor, Additional Living Expense (ALE) benefits remain subject to your specific policy coverage limits, exclusions, and active claim status. If your insurance carrier denies coverage, exhausts your Coverage D monetary or temporal limits, or fails to remit approved payments due to policy cancellation or fraud, the policyholder remains ultimately responsible for outstanding rental balances incurred during their occupancy.
  • Coverage Verification Consent: By submitting your insurance details and policy declaration pages, you grant us authorization to contact your assigned claim adjuster to verify housing limits, propose lodging rates, and coordinate stay authorizations.

4. Temporary Occupancy & Housing Rules

  • No Tenancy Creation: Placement in our corporate housing properties constitutes a temporary lodging accommodation for emergency relocation purposes. Occupancy is governed by our Corporate Temporary Occupancy Agreement and does not establish a permanent standard residential tenancy.
  • Authorized Occupants: Only individuals listed on the initial housing intake form and occupancy agreement are permitted to reside in the home. Unauthorized sub-leasing, short-term hosting (e.g., Airbnb/Vrbo subletting), or business operations on the premises are strictly prohibited.
  • Care of Property & Utilities: Occupants must maintain the furnished property in clean, undamaged condition. Homes are provided with bundled commercial utilities and internet. Excessive utility consumption beyond reasonable residential allowances or negligent property damage will be billed to the occupying policyholder.
  • Pet Policies: Pets are permitted only in designated pet-friendly properties where breed, count, and weight have been formally declared and approved during intake. Undisclosed pets are subject to non-refundable violation fees and potential removal.

5. Stay Duration, Extensions & Vacating Procedures

  • Target End Dates: Check-in and scheduled check-out dates are determined in coordination with your assigned adjuster and structural repair schedule.
  • Extension Requests: If home reconstruction is delayed, occupants or their contractors must submit a lease extension request via our Client Portal at least 14 to 30 days prior to the current scheduled end date. Extensions are subject to property availability and written adjuster approval.
  • Vacating the Home: Upon completion of repairs or expiration of approved ALE benefits, occupants agree to vacate the property promptly on the agreed date, remove all personal items, and leave the property in broom-clean condition.

6. Portal Usage & Account Security

Access to the MP Housing Solutions Client Portal is personal and non-transferable. You are responsible for safeguarding your login credentials and for all activities conducted under your portal account. You agree not to upload malicious code, falsify claim documentation, or misuse communication tools within the platform.

7. Limitation of Liability & Disclaimers

  • "As-Is" Services: All temporary accommodations, digital portals, and coordination services are provided on an "as-available" basis. While we verify inventory standards, we do not warrant that third-party partner properties will meet every personal aesthetic preference.
  • Claim Determinations: MP Housing Solutions & ALE is not liable for insurance coverage disputes, delays in carrier claim processing, denial of ALE coverage by your adjuster, or disputes between you and your restoration contractor.
  • Damages Cap: To the maximum extent permitted under Tennessee law, the Company's total aggregate liability arising out of or related to these terms or property occupancy shall not exceed the total corporate housing fees paid to the Company for the specific placement at issue.

8. Governing Law & Dispute Resolution

These Terms of Service and any related occupancy disputes shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Montgomery County or Davidson County, Tennessee, and all parties consent to personal jurisdiction therein.
